Regulations Governing the Fund / Technical Cooperation and Assistance
Article I
These Regulations are prescribed pursuant to Article 17 of the Statute for the Establishment of the International Cooperation and Development Fund (hereinafter referred to as the "Fund").
Article II
The Fund may provide technical cooperation and assistance to:
- Friendly or developing countries which:
Have diplomatic relations with the Republic of China (ROC).
Do not have diplomatic relations with the ROC, yet intend to cooperate with
the ROC in economic development and to improve substantive relations.
- Any non-governmental organization as designated by the friendly or developing countries as referred to in the foregoing item (1).
- International organizations or agencies or any organization or corporate body designated by these international organizations or agencies.
Article III
Technical assistance or cooperation from the Fund to be provided in accordance with the Fund's annual plans, or based on specific projects for which technical cooperation and assistance is requested, must in both cases be for the following purposes:
- Conducting training courses for government officials of friendly or developing countries or for people as recommended by the organizations or institutions referred to in items (2) and (3) of Article II.
- Sending experts or staff to friendly or developing countries to help conduct various training, advising or consulting plans as necessary for the development of the countries concerned.
- Conducting planning, research, assessment, or other projects studies.
- Donating equipment complementary to the activities referred to in the foregoing items in this Article.
- Any other project that is in line with the Fund's purpose to provide technical cooperation and assistance.
Article IV
Technical cooperation and assistance provided in accordance with the ICDF's
annual plans shall respect the following procedures:
- Training courses
1. Before the start of each fiscal year, the Fund shall, in consultation with the competent authorities having jurisdiction over the Fund and embassies or representative offices of the ROC, make an annual plan of the courses to be conducted, including number of trainees to be admitted and budget. The Fund shall submit the plan to the Board of Directors for approval.
2. The information related to the approved plan will then be passed on to the embassies or representative offices concerned, which will advise the government or institutions to recommend trainees.
3. The concerned embassies or representative offices will review the recommended list of candidates before the Fund conducts a final review.
4. The lists of selected trainees will be sent by the Fund to the government or institution concerned through the relevant embassies or representative offices.
5. The Fund will supervise the implementation of the relevant technical assistance and cooperation and review their outcome at the end of each year.
- Project implementation
1. Before the start of each fiscal year, the Fund shall, in consultation with the competent authorities having jurisdiction over the Fund and embassies or representative offices of the ROC, shall prepare a budget plan for technical assistance and cooperation projects to be done in the coming year. The Fund shall submit this plan to the Board of Directors for approval.
2. Implementation schemes for technical cooperation and assistance projects should be formed to suit the basic needs of the friendly or developing countries. They should contain implementation procedures, timetables and required expenditures, and must be submitted to the Board for approval before being sent to the relevant embassies or representative offices who are in charge of introducing the schemes to target countries.
3. The Fund will use the project schemes as a base for entering into memoranda, agreements or other necessary documents with the recipients of the relevant technical cooperation and assistance projects. Implementation reports for such projects will be submitted to the Board.
4. In the event that the projects are carried out by an institution designated by the Fund, the institution shall provide the Fund with a completion report within two months after the completion of the project concerned.
5. During any technical cooperation and assistance projects implementation period, periodical reports in relation to the implementation progress and outcome review should be submitted to the Board.
Article V
The execution procedures for project-based technical cooperation and assistance
shall be as follows:
- Application by a country to the Fund for a technical cooperation and assistance project shall be done through a ROC embassy or representative office. The Fund may also provide technical assistance in special cases upon request from the Ministry of Foreign Affairs.
- Application documents will be first reviewed by the embassies or representative offices, which will evaluate the project's benefits to, and influence on, mutual relations with the applicant country before delivering the application to the Fund for final review.
- The Fund will use the application documents as a base to assess the effectiveness of the projects concerned and, if judged necessary, may send officers to conduct preliminary feasibility studies or feasibility studies.
- After an application is approved by the Fund, the Fund will enter into technical cooperation agreements or other agreements with the recipient of the technical cooperation and assistance.
- In the event that the projects are carried out by an institution designated by the Fund, the institution should provide a completion report to the Fund within two months after the completion of the projects concerned.
- If a project has been appraised as eligible for financing from the Fund, the Fund may limit its funding for technical cooperation and assistance to a sum of up to US$300,000. Any excess amount that may be judged necessary for completion of the project can be added to the supplemented by the Fund in the form of a loan.
Article VI
The following documents shall accompany applications for project-based technical cooperation and assistance:
- An application statement, except for an application made at the request of the Ministry of Foreign Affairs.
- An introduction to the applicant and its structure and charter.
- A project plan, including project description, implementation plan and other related matters.
Article VII
The standards for appraisal of an application for technical cooperation and assistance from the Fund will be submitted by the Fund to the Board for approval
Article VIII
The Fund may retain foreign or domestic, public or private organizations to carry out technical cooperation and assistance if necessary. The standards and procedures for selecting such executing organizations will be approved by the Board before being submitted to the competent authorities having jurisdiction over the Fund for reference.
Article IX
The Fund will supervise the technical cooperation and assistance which is in progress and carry out assessment and review within three months after the completion of the projects concerned. If necessary, the Fund may send its officers to do on-site supervision, assessment or review of the projects, and may also retain overseas or domestic professional organizations or overseas representative offices to carry out these activities.
